Following the recent release of the FMA’s report in March Update on the FMA’s on-going review of insurance replacement business and conflicted conduct there has been a lot of media interest in replacement business.

Hear directly from the FMA about its views on best practice and what its report can tell the industry. Then look at case studies of complaints to the IFSO Scheme to see what it considers when looking at whether an adviser has exercised the care, diligence and skill that a reasonable financial adviser would exercise in the same circumstances.

This webinar will look at financial advisers obligations to:

• Use due care, diligence and skill
• Keep records
• Address conflicts of interest

Presenters

Michael Hewes, Manager, Supervision, Financial Markets Authority
Michael leads a team responsible for licensing new market entrants and supervising existing market participants such as AFA’s, Supervisors, FMCA licence holders. Michael was recently involved with the Digital Advice exemption notice, and also leads the Monitoring and Enforcement Work stream for the proposed FSLAB. Michael has been with the FMA for 18 months, having previously worked in the insurance industry for 20 years across a range of functions.

Toni Hadden, Adviser, Financial Markets Authority
Toni is an Adviser in the Conduct Assessment Team at the FMA. The Conduct Assessment Team sits within the FMA’s Regulation Team and is primarily responsible for the FMA’s work on the regulatory perimeter, made up of businesses and individuals that do not hold a license, including RFAs. Toni is an Authorised Financial Adviser and has been with the FMA for 3 years.

Virginia has more than 15 years’ experience working as a lawyer in financial services. Virginia is an experienced presenter and a specialist in dispute resolution for the financial services sector.
